A judge denied a motion from a convicted sex offender to withdraw a guilty plea the man made earlier. Marvin Smith said he plead guilty because he was upset and scared at the time.
Smith originally plead guilty to one count of criminal sexual assault. The deal had a sentencing range of six to 15 years. The charge stems from evidence against Smith from a woman saying she went back to his apartment and described being slapped, punched, bitten and strangled in a whirlwind of assaults. She also said she was held against her will and raped.
Smith had been told without taking the plea, his range of conviction was six to 60 years. Smith now maintains his innocence and says anything that happened between him and the female was consensual.
